The primary focus of this research is to demonstrate how Ushul Fiqh provides a systematic methodology that enables Muslims to extract legal rulings from authentic sources and apply them to various aspects of daily life. The study also investigates how Ushul Fiqh bridges the gap between religious texts and the evolving social realities, and how these principles can help resolve contemporary legal issues that are not explicitly addressed in the Qur'an or Hadith. This research adopts a descriptive-analytical approach, reviewing a wide range of classical and modern literature in Ushul Fiqh. It also includes an analysis of how the principles of Ushul Fiqh are applied in addressing contemporary legal issues, such as family law, Islamic economics, and social laws related to the progress of time and technology. The findings of this study suggest that Ushul Fiqh not only provides a means for understanding Islamic law but also functions as a foundational framework for thinking critically and systematically in addressing more complex legal matters. Now, all institutions, whether an Islamic bank or an Islamic non-bank, are required to enact contracts in each transaction or agreement made by contracting parties, meaning a mutually acceptable, binding, voluntary agreement. This study investigates the implementation of contracts at the Muhammadiyah Yogyakarta Sharia Pension Fund—an example of a non-bank Islamic financial institution in Indonesia—abiding by sharia contracts according to the OJK Regulation No. KEP-02/D.05/2019 and Muhammadiyah Yogyakarta Sharia Pension Fund Regulation No. KEP-65/NB.21/2022. Article 6 mentions the contents of various contracts, including Hibah bi Syarth, Hibah Muqayyadah, Wakalah, Wakalah bil Ujrah, Mudarabah, Ijarah, and other contracts aligned with the guidelines of DSN-MUI. This research further analyses the challenges of compliance in contract application and operations after the introduction of the sharia system. The study employs descriptive analysis using a field research approach with a juridical empirical study on regulation governing Islamic pension fund agreements. Other than using interviews and observations, the study will also adopt field documentation at Muhammadiyah Yogyakarta Sharia Pension Fund. According to current findings, contracts find application in both oral and written forms, although some officials do not know that their acts are actually contractual agreements. Contracts are conducted according to the stated regulations. The greatest challenge relates to asset transformation into sharia-compliant forms and the deepening of personnel understanding on the application of contracts. One of the dominant innovations today is the PayLater payment method, which allows consumers to purchase goods or services and pay for them at a later date. This research aims to analyze the Shopee PayLater system from the perspective of the special rules of Fiqh Muamalah, in order to understand its compatibility with Islamic economic principles. The analysis of Shopee PayLater involves an in-depth study of the concept and operational mechanism, as well as a comparison with the principles of Fiqh Muamalah. These debates sometimes spiral out of control, resulting in the use of insulting or degrading language among participants, which is considered to undermine the authority and dignity of the court a situation referred to as contempt of court. Consequently, advocates have been reported for such behavior.</p> <p style="font-weight: 400;">This paper therefore examines three main issues: first, how the judicial system and the concept of contempt of court operate in Indonesia; second, how contempt of court relates to the immunity rights of advocates; and third, what factors influence advocates to commit acts that may constitute contempt of court during trials.</p> <p style="font-weight: 400;">This study employs empirical legal research with a conceptual approach, utilizing secondary data consisting of: (1) primary legal materials, which include fundamental norms such as the 1945 Constitution of the Republic of Indonesia, statutory regulations, uncodified legal materials, and jurisprudence; (2) secondary legal materials, which explain primary legal materials, such as draft laws, research findings, and scholarly works in the field of law; and (3) tertiary legal materials, which provide guidance or explanations of both primary and secondary legal materials, such as dictionaries and encyclopedias.</p> <p><span style="font-weight: 400;">The findings reveal that: (1) Indonesia’s judicial system adheres to a “combined system”, and contempt of court refers to any act that may be considered to humiliate, obstruct, hinder, or undermine the duties of the judiciary; (2) the immunity rights of advocates and the concept of contempt of court are interrelated and mutually supportive in maintaining the dignity and authority of the judiciary; and (3) acts of contempt of court committed by advocates during court proceedings are influenced by several factors, including: (a) the structure of the legal system, (b) the substance of the law, and (c) the legal culture.</span></p> Kahar Kahar Retno Wulan Copyright (c) 2025 Kahar Kahar, Retno Wulan https://creativecommons.org/licenses/by-nc-sa/4.0 2025-09-30 2025-09-30 5 2 105 129 10.36915/jish.v5i2.452 Engagement dan Pergaulan Pra-Nikah: Kajian Hukum Islam Atas Realitas Sosial Masyarakat Kontemporer https://journals.ddipolewalimandar.ac.id/index.php/jish/article/view/460 <p>Engagement (<em>khitbah</em>) is a social tradition practiced in many communities as a form of commitment between two individuals preparing for marriage. In modern contexts, engagement is often understood as an emotional and social bond that legitimizes closer interaction, including physical intimacy. However, in Islamic law, engagement does not carry legal consequences that equate the couple’s status with that of husband and wife. This study aims to examine patterns of interaction during the engagement period using a normative-theological approach. Analysis of primary Islamic legal sources such as the Qur’an, Hadith, and both classical and contemporary <em>fiqh</em> literature reveals that engagement is merely an initial promise toward marriage without granting rights or obligations equivalent to a valid marriage contract. Therefore, Islamic boundaries (<em>hudūd syar‘iyyah</em>) must be observed to prevent acts leading to fornication (<em>zina</em>) or the violation of personal dignity. Practices such as corruption and abuse of power have diminished political integrity and public trust. Using a normative legal approach, this research analyzes relevant regulations and Islamic legal principles of justice (‘adl) and trust (amanah). The findings reveal that transactional politics not only violate existing laws but also contradict the objectives of Islamic law (maqāṣid al-syarī‘ah), which emphasize justice, integrity, and social responsibility. From the perspective of Islamic law, political power is a trust that must be exercised for the welfare of the people, not for personal gain. Namun, penggunaan teknologi ini menimbulkan tantangan terhadap jaminan kepastian hukum serta perlindungan hak atas privasi warga negara sebagaimana dijamin dalam UUD 1945, khususnya Pasal 28D ayat (1) dan Pasal 28G ayat (1). Artikel ini bertujuan untuk menganalisis kerangka hukum yang mengatur penggunaan AI dalam pelayanan publik, mengidentifikasi potensi permasalahan hukum, dan mengevaluasi sejauh mana regulasi yang ada mampu memberikan perlindungan terhadap hak-hak konstitusional masyarakat. Melalui pendekatan yuridis-normatif, kajian ini menemukan bahwa belum terdapat regulasi khusus yang secara komprehensif mengatur standar etika, akuntabilitas, transparansi algoritmik, dan mekanisme perlindungan data dalam sistem AI. Komisi Perlindungan Anak Indonesia (KPAI) baru saja merilis data yang cukup mencegangkan terkait kasus perundungan atau <em>bullying</em>. Tercatat, terdapat 1.052 kasus pelanggaran hak anak yang diterima sepanjang tahun 2025 berlangsung. Metode Penelitian ini menggunakan metode penelitian yuridis normatif. Pendekatan yang digunakan adalah pendekatan perundang-undangan <em>(statute approach)</em>. Bahan hukum yang digunakan dalam penelitian ini yaitu bahan hukum primer dan bahan hukum sekunder. <em>Bullying </em>yang masih terjadi di lingkungan pendidikan yaitu sekolah, ini telah menunjukkan bahwa masih kurangnya pengawasan orang tua terhadap anak serta belum pahamnnya anak terhadap konsekuensi akibat dari melawan hukum sedangkan para korban <em>bullying</em> sering kali tidak mendapat ganti rugi atau pemulihan secara perdata dari pelaku, padahal secara yuridis korban berhak menggunggat ganti rugi atas sebuah kerugian yang telah ditimbulkan dari perbuatan melawan hukum berdasarkan pasal 1365 KUH Perdata dan yang kedua bentuk Pertanggungjawaban perdata pelaku <em>bullying</em> terhadap korban yaitu orang tua pelaku yang dapat dimintai pertanggungjawaban atas dasar perbuatan melawan hukum (PMH) berdasarkan pasal 1367 ayat (2) KUH Perdata.
